The client agrees to these Terms automatically. These conditions will be made aware at the time of booking. 

Definitions

For the purpose of these conditions ‘the client’ is any individual who has made a payment to Lizzy Nelson Photography for a photography session, along with all attendees of the photography session the payment relates to. 

‘The photographer’ refers to Lizzy Nelson trading as ‘Lizzy Nelson Photography’.

Agreement

This contract comes into effect from the date of receipt of any payment by the client to the Photographer. By making a payment to the photographer the client agrees to these Terms and Conditions. Unless otherwise agreed in writing, all services and goods provided to the client will be subject to the terms and conditions of this agreement and the details provided by the client in the Booking Form.

The photographer has the right to change information regarding rates and agreements at all times.

Deposits and Payment

Prices will be confirmed with the client prior to booking. Payment is divided into a deposit and balance payment. 

Upon payment of the deposit, the Photographer will reserve the client session date. The Photographer will not hold the session date and will have no liability for, or duty to, photograph the session until the deposit is paid.

The remaining balance of the package is due on or before the wedding date.

If the client wishes to upgrade their package, this must be communicated in advance of the wedding date and is subject to availability. 

Due to the bespoke nature of photography, digital images are non-refundable upon delivery of your online gallery.

Cancellation

The Client acknowledges that a non-refundable deposit of 50% of the total fee is required to secure the booking. The remaining balance must be paid on or before the date of the wedding. Should the Client wish to cancel the booking, they may do so at any time prior to the wedding date; however, the deposit will be retained by [Business Name] and is not refundable under any circumstances. No further fees will be payable provided cancellation occurs prior to the wedding date. If cancellation occurs on or after the wedding date, the full balance will be deemed payable.

Failure to perform 

In the unlikely event that Lizzy Nelson Photography is unable to photograph the Wedding Day due to illness, emergency, accident, or other unforeseen circumstances beyond their control, the Photographer will, where possible, provide the Client with details of other professional photographers who may be available. Lizzy Nelson Photography is not responsible for securing or covering the cost of an alternative photographer. In such circumstances, Lizzy Nelson Photography will refund any monies paid, including the deposit. This refund shall constitute the sole and entire liability of Lizzy Nelson Photography under this Agreement. No further damages, compensation, or guarantees of any kind shall be due.

Rescheduling

If the Client wishes to reschedule the session, this will be subject to the Photographer’s availability. Where a new date is agreed by both parties, the deposit will be transferred to the revised booking. If no mutually suitable date can be arranged, or if the Photographer is unavailable on the Client’s preferred date, the original deposit will be forfeited and treated as non-refundable.

Artistic Rights

The Photographer retains the right of discretion in selecting the photographic materials released to the client. The photographer has the right to refuse any requested edits to the images and will not release unedited digital files or RAW files. 

Edited Images

The photographer will edit images to their own taste, light touch ups include blemishes, skin patches, tones and white balance.

Heavy Editing

Any heavy editing that goes against the photographers business values will be declined, ie, body alterations, changing face appearance. Any other heavy edits will be require external editor touch ups. This will incur an extra cost on top of the package price. This includes but not limited to, object removal in awkward placements in an image.

Client Usage

The photographer shall not be held accountable for any dispute, claim, damage or legal costs arising out of the clients use of the images. 

Photographers Usage 

When booking a photo shoot, the client gives permission to the photographer to use the images taken for business and commercial purposes, ie Website and Social Media. If the client does not wish this, the client must inform the Photographer. 

Photos are never transferred to another company without permission. 

Permission must always be requested from the client for publication in any magazines.

Copyright 

The entire copyright, title, and intellectual property rights of any Images will remain that of The Photographer at all times.

Client Confidentiality

The Photographer will not disclose to third parties or make use of information communicated by the client in confidence for the purposes of the photography session.

Creative License

The Photographer(s) shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. The style and the number of photographs are also dependent on vagaries of the weather and the availability and willingness of the clients and their guests. The Photographer(s) will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement. Due to the fact it is a "live" event it may not be possible to capture all the images requested.

Complaints 

All complaints should be made in writing via email to the photographer. 

Complaints will be responded to within 7 days. 

Liability

The photographer is not liable for physical or material damage caused during the photo shoot, unless there is gross negligence or intent on the part of the photographer. While Lizzy Nelson Photography takes the utmost care with respect to exposure, processing and delivery of photographs, in the event that the images become lost, stolen or destroyed, for reasons beyond the control of the photographer(s), liability is limited to a refund of retainer and payment received. The limit of liability shall not exceed the contract price. The photographer(s) will not be held responsible for any ruined photographs due to any cause outside of their control.

Storing Images

Lizzy Nelson Photography will hold your images on an online gallery for 12months. After this time they will be removed from the platform. It is the clients responsibility to download and safely store their images onto their own hard-drives after purchase. Lizzy Nelson Photography will not be held responsible for any lost or stolen images, nor is the platform a storage facility.
